Terms of Service

Welcome to BASELIT. These Terms of Service ("Terms") govern your use of the BASELIT mobile application ("App") operated by BASELIT ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use BASELIT. By creating an account, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of age and to terminate accounts if eligibility requirements are not met.

2. Account Registration

You may create an account using email and password, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. You must notify us immediately at hello@baselitapp.com if you suspect unauthorized access to your account.

BASELIT is not a medical service. All workout suggestions, nutritional estimates, and body composition analyses are generated by algorithms and artificial intelligence. They are for informational and educational purposes only and should not be considered medical advice, diagnosis, or treatment.

AI-powered nutritional estimates from food scans are approximate and may not reflect actual nutritional content. Always verify critical dietary information with a qualified nutritionist or by consulting food packaging labels.

Consult your physician or qualified healthcare professional before starting any new exercise program, especially if you have pre-existing health conditions, injuries, or are taking medication (including GLP-1 medications). You use all workout and nutrition recommendations at your own risk.

5. Subscriptions & Payments

Free Tier: Includes basic features with limited daily AI food scans (5 per day) and access to core workout and tracking features.

Pro Subscription: Unlocks unlimited AI food scans, advanced analytics, detailed nutrition insights, and priority support. Pro is available as a monthly or annual subscription.

All payments are processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID Account Settings. Refunds are handled per Apple's refund policy. Prices may change with reasonable notice provided through the App or App Store listing.

We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines without prior notice.

8. Your Content

You retain ownership of all content you submit (photos, workout data, check-in entries). By submitting content to community features, you grant BASELIT a non-exclusive, worldwide, royalty-free license to display that content within the App for the purpose of providing community features. This license ends when you delete the content or your account. Private data (personal workout logs, meal scans not shared to community) remains private and is only used to provide you with App services.

9. Intellectual Property

The BASELIT name, logo, design, code, workout algorithms, and all App content are owned by BASELIT and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works based on the App or its content without our prior written consent.

We may suspend or terminate your account at our discretion if you violate these Terms, engage in abusive behavior, or for any reason with reasonable notice. You may delete your account at any time by contacting hello@baselitapp.com. Upon termination, your right to use the App ceases immediately. Data deletion follows our Privacy Policy (within 30 days of account deletion). Active subscriptions should be cancelled through Apple to avoid continued billing.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure. AI-generated content (nutritional estimates, workout suggestions) is provided without guarantee of accuracy or completeness.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASELIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE APP. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless BASELIT and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another party.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through in-app notifications or by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you disagree with the changes, you should stop using the App and delete your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
